THE FOURTH SCHEDULE
Restrictive Stipulations
1. To pay a reasonable proportion of the expense of repairing and
maintaining all party walls or fences sewers drains watercourses wires
and cables and other things used or enjoyed in common by the occupiers
of the premises hereby conveyed and the occupiers of any other
adjoining premises and such proportion in case of dispute or difference
shall be determined by the Corporation whose decision shall be final
and binding upon the parties
2. Not to use or allow or cause the said land and premises hereby
conveyed to be used for any purpose other than that of a private
dwellinghouse and the premises hereby conveyed shall not be occupied by
persons in excess of the permissible number as defined in the Sixth
Schedule to the Housing Act 1957
3. Not to do cause permit or suffer upon the said premises hereby
conveyed anything which may be or become a nuisance or annoyance or
which may cause damage to the Corporation or other tenants or the
occupiers of the neighbouring land and premises of the Corporation
4. Not to allow the decorative or structural condition of the premises
hereby conveyed to become such as will depreciate the value of the
surrounding properties
5. To keep the fences of the premises hereby conveyed where marked
with a T mark inwards on the said plan annexed in good and substantial
repair and condition"
In addition, some of the Conveyances are varied to include the
following covenants immediately after clause 4 of the covenants set out
above:-
"(E) To keep all walls or fences of the said property in good repair
and condition
(F) Not to alter the said property or any buildings erected thereon
hereafter or to erect any buildings thereon or make any opening in the
party walls or fences thereof without the consent in writing of the
Council
(G) Not to keep on the said property any motor vehicle in excess of

(H) Not to plant any trees or shrubs in or on any land shown hatched
red on the said plan nor to build or erect any building or erection
whatsoever on any land shown hatched red on the said plan.
